Terms of Service

The agreement between you and MyLantite when you use the service.

Last reviewed:

1. Who we are

These Terms of Service ("Terms") form an agreement between you and MyLantite (ABN 70 829 483 156) ("we", "us", "our"). We provide an online platform that helps individual learners prepare for the Literacy and Numeracy Test for Initial Teacher Education (LANTITE) and similar standardised exams.

By creating a MyLantite account, ticking the "I agree to the Terms of Service and Privacy Policy" checkbox at signup, or using the service in any way, you accept these Terms. If you do not accept them, do not use the service.

2. About the service

MyLantite gives you:

  • Practice questions that mirror the LANTITE format, with detailed explanations.
  • Structured study lessons covering literacy and numeracy content.
  • Adaptive analytics that show you where to focus.
  • Optional social features (challenges, friends) and gamification.

We may add, remove, or change features at any time. We will give reasonable notice of material removals, and we will not retroactively withdraw features you have already paid for in the current billing period.

3. Eligibility

You must be at least 16 years old to use MyLantite. By accepting these Terms you confirm that you meet that minimum age. We verify your age at signup using the date of birth you provide.

The service is currently designed for users in Australia. You can use it from elsewhere, but features such as Australian-formatted invoices, the LANTITE-aligned content, and AUD-only pricing are tailored to the Australian market.

4. Your account

When you create an account you agree to:

  • Give us accurate, current, and complete information at signup, including your real name and date of birth.
  • Keep your password confidential - anyone who has it can use your account.
  • Use the account yourself - accounts are personal. Do not share your account credentials, and do not let another person take exams or lessons in your place.
  • Notify us at [email protected] if you suspect your account has been compromised.

You are responsible for all activity that occurs under your account, except where that activity results from our breach of these Terms or a failure of our security described in the Privacy Policy.

5. Subscriptions, renewals, and cancellation

5.1 Free trial

New users start on a free trial with no card required. The current trial length is shown on the pricing page. During the trial you have access to the same content as paid users. We will send you a reminder before the trial ends so that you can choose a paid plan if you want to continue.

5.2 Paid plans and auto-renewal

If you choose a paid plan, we charge the amount and the interval shown on the plan-checkout screen - for example, "$X every month" or "$X every 6 months". If you are not on a free trial, the first charge is taken on the day you subscribe. If you choose a paid plan while still on your free trial, nothing is charged until the trial ends - the first charge lands on the first day of that plan's billing period, which starts when the trial does. Either way, the plan then renews automatically at the same amount and interval, charged in advance, until you cancel.

The exact amount and timing shown on the checkout screen before you confirm forms part of these Terms - by confirming, you authorise that charge and, unless you cancel, every recurring charge after it.

If the price of your plan changes, we will tell you by email at least 30 days before the new price takes effect. You can cancel before the new price applies if you do not want to continue at the new amount.

All prices are shown and charged in Australian dollars (AUD). Where GST applies to your purchase, it is calculated at checkout and itemised separately on the ATO-compliant tax invoice we issue for each successful payment. You can view and download your tax invoices at any time from Settings → Billing.

5.3 Cancellation

You can cancel at any time from Settings → Billing. Cancellation takes effect at the end of your current billing period - you keep access to the paid features until then, and you will not be charged again.

We do not retroactively refund prior billing periods on cancellation (see section 6 for the refund position required by Australian Consumer Law).

5.4 Failed payments

If a renewal payment fails - for example, because your card has expired - we will email you. We do not automatically retry the payment. Your subscription is not changed at the time of the failure: you keep access until the end of your current billing period, after which the subscription lapses unless you update your payment method and pay. Paying after it has lapsed restores the same subscription.

6. Refunds and consumer guarantees

MyLantite is a service, not a good - we do not sell or supply any physical product. Our service comes with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). For major failures with the service, you are entitled to:

  • Cancel your service contract with us; and
  • A refund for the unused portion, or to compensation for the reduced value.

If the failure does not amount to a major failure, you are entitled to have the problem fixed in a reasonable time and, if it is not, to cancel and obtain a refund for the unused portion.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law. To request a refund under a consumer guarantee, contact [email protected] with your account email and a description of the issue.

Outside the consumer-guarantee context, we generally do not offer refunds for unused time on a paid plan - the trial period is the opportunity to confirm the service meets your needs before paying. We may grant goodwill refunds at our discretion.

7. Acceptable use

When you use MyLantite you agree not to:

  • Copy, scrape, or systematically download our practice questions, lessons, or other content for use outside the service.
  • Resell or sublicense access to the service, or use a single account to deliver the content to multiple people.
  • Impersonate another person, give us false information, or sign up using an automated process.
  • Attempt to reverse-engineer, decompile, probe for vulnerabilities, or interfere with the security of the service.
  • Upload, transmit, or generate content that is illegal, defamatory, harassing, infringing, or that breaches another person's rights.
  • Use the service to send spam, phishing, or otherwise abusive communications.

Responsible-disclosure security research is welcomed and is exempt from the no-probing rule above, provided you follow the contact and scope guidance at /.well-known/security.txt.

8. Intellectual property

The MyLantite service - including its software, brand, design, written content, question banks, study lessons, illustrations, and analytics models - is owned by us or our licensors and is protected by Australian and international copyright, trademark, and other intellectual-property laws.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the service for your own LANTITE preparation while you have an active account. Nothing in these Terms transfers ownership of the service or its content to you.

"LANTITE" is administered by ACER and the trademark is owned by them; we are not affiliated with ACER and we are not the official LANTITE provider.

9. Your content

Some features of the service let you create content - for example, your practice tests or your profile fields. You keep ownership of the content you create.

By submitting content to the service you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and otherwise process that content for the purpose of operating the service and providing it to you. The licence ends when you delete the content or close your account, except where we are required by law (for example, tax invoices) to retain a copy.

We do not claim ownership of your content, and we do not use it to train AI models.

10. No exam-pass guarantee

MyLantite is an educational tool. We make no promise, representation, or guarantee that you will pass the LANTITE or any other exam by using it. Your result depends on many factors outside our control - including how much you study, your prior knowledge, and how the official exam is administered on the day.

This statement is provided alongside, and does not limit, your rights under the Australian Consumer Law described in section 6.

11. Liability

To the maximum extent permitted by Australian law:

  • The service is provided "as is" and "as available" - we do not make any warranty about availability, fitness for a particular purpose, or freedom from error, except where the Australian Consumer Law gives you a non-excludable guarantee.
  • We are not liable for indirect, consequential, special, or incidental loss - including loss of profits, revenue, business, goodwill, data, or anticipated savings - arising out of your use of the service, whether the claim is made in contract, tort (including negligence), under statute, or otherwise.
  • We are not liable for any failure or delay caused by a third-party service we rely on - for example, our payment processing gateway, a third-party sign-in provider, or our hosting, network, or content-delivery providers - or by anything else reasonably outside our control.
  • Our total aggregate liability to you in any 12-month period is limited to the greater of (a) the amount you have paid us for the service in that period, or (b) AUD $50.

Important: nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law (sections 54-64 of Schedule 2 to the Competition and Consumer Act 2010) where that consumer guarantee, right, or remedy cannot be excluded.

12. Suspension and termination

You can close your account at any time by emailing [email protected] from the address on your account. We action closures within 7 business days.

We may suspend or terminate your access if:

  • You materially breach these Terms (including the acceptable-use rules in section 7).
  • Your payment fails and you do not update your payment method.
  • We are legally required to do so.
  • Continuing to provide the service to you creates a security or legal risk for us or for other users.

Where the breach is capable of being fixed, we will try to give you notice and a reasonable opportunity to fix it before suspending or terminating, except where the breach is so serious (for example, a security attack against the service) that immediate action is required.

On termination, the licence in section 8 ends, your right to use the service ends, and we will delete or de-identify your personal information per the Privacy Policy.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes - for example, changing the cancellation rules, the liability cap, or how subscriptions renew - we will:

  • Email all active users at least 30 days before the change takes effect.
  • Show an in-app banner pointing to the updated Terms for at least 30 days.
  • Update the "Last reviewed" date at the top of this page.

If you do not accept a material change, you can cancel your subscription and close your account before the change takes effect. Continued use after the change takes effect means you accept the new Terms.

Minor edits (typos, restructuring, clearer phrasing without changing meaning) may be applied without notification.

14. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Disputes will be resolved by the courts of New South Wales, Australia (and the federal courts of Australia when applicable), and you agree to submit to the non-exclusive jurisdiction of those courts.

Nothing in this clause prevents you from bringing a dispute in the small-claims tribunal of your state or territory, or from exercising any other right that the Australian Consumer Law gives you.
